§ 1. GENERAL PROVISIONS
1. These Terms (hereinafter referred to as the “Terms“) refer to a Charity Event under the name “#DisplateForTrees” in relation to Earth Day (hereinafter referred to as the “Charity Event“).
2. The Charity Event is organized by GWD Concept sp. z o.o. with its registered office in Warsaw 02-017, Aleje Jerozolimskie 123A, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw, XII Commercial Division of the National Court Register under entry No. 0000451277, NIP (Tax Identification Number) 9512364589 (hereinafter referred to as the “Organizer“).
3. The beneficiary of the Charity Event is Trees for the Future, Inc., with its registered seat at the address: 1400 Spring Street, Suite 500, Silver Spring, Maryland 20910, United States of America, EIN: 52-1644869 (hereinafter referred to as the “Beneficiary“).
4. The Participant of the Charity Event is each owner of an account on the social network Twitter or Instagram, who during the period of the Charity Event, i.e., from April 1, 2022, 00:00 CEST until May 8, 2022, 23:59 CEST will post a picture of their drawing of tree(s) on the framed area of the cardboard provided by Organizer with shipping of purchased Displate poster(s) and will add #DisplateForTrees to this picture, as defined in § 2. point 2 of the Terms (hereinafter referred to as the “Participant“).
§ 2. CHARITY EVENT
1. The Charity Event will be carried out on the social networks Twitter (www.twitter.com) and Instagram (www.instagram.com).
2. The Charity Event will start on April 1, 2022, at 00:00 CEST, and will end on May 8, 2022, at 23:59 CEST. To participate in the Charity Event, the Participant shall meet the following requirements jointly:
1) post a picture of their drawing of tree(s) on the framed area of the cardboard provided by the Organizer with shipping of purchased Displate poster(s) on the Participant’s Twitter or Instagram account and
2) add #DisplateForTrees to this picture (hereinafter referred to as the “Picture“).
No Pictures will be counted after this time.
3. The Picture will be counted in the Charity Event if it is of high quality; the drawing is made inside the cardboard frame and can be easily recognized. No vulgar or unethical Picture will be counted in the Charity Event.
4. The Organizer is entitled to share Pictures on their Twitter account (https://twitter.com/displate) and their Instagram account (https://www.instagram.com/displate/) as well as to share the Participant’s nickname.
5. Only one Picture will be counted in the Charity Event of one Participant’s account on Twitter or Instagram.
6. For one Picture made during the period of the Charity Event in accordance with these Terms, the Organizer will pay to the Beneficiary a donation equal to the price of planting five trees. Total Organizer’s donation from the pictures will not exceed the price of planting 100,000 trees.
7. Donations will only be valid when the Picture has been posted during the period of the Charity Event in accordance with these Terms.
8. The Organizer will calculate the number of Pictures made in accordance with these Terms.
9. The Organizer will inform about the results of the Charity Event via its Twitter and Instagram account (https://twitter.com/displate) & (https://www.instagram.com/displate/) at the latest within 14 days after the end of the Charity Event.
§ 3. PARTICIPANTS’ RIGHTS AND OBLIGATIONS
1. Participants are obliged to comply with these Terms of Charity Event and with Twitter and Instagram rules and policies.
2. By participating in Charity Event, the Participant agrees to these Terms.
3. The right to participate in the Charity Event is granted only to those Participants who meet all the conditions of participation specified in these Terms.
4. Participants are obliged to use their real personal accounts to post the Picture. No Pictures posted from fake accounts or by a bot will be counted. The Organizer has the right to verify the authenticity of the Participant’s account.
5. Participation in the Charity Event is voluntary and free of charge.
6. The Organizer has the right to repost the Participant’s nickname and verify the authenticity of the Participant’s account, and as such personal data may be processed. Please refer to the Privacy Policy on https://displate.com/about-privacy to learn about the safety of personal data and your rights regarding the processing of your personal data.
7. Organizer has appointed DPO who can be contacted by email address found in Privacy Policy. The Data Protection Officer may be contacted for matters related to personal data processing and any associated rights you might have in relation thereto. Mentioned data will be processed by the Organizer (the data controller) as processing is necessary for the purposes of the legitimate interests pursued by the controller to determine, investigate or defend potential claims and for marketing purposes involving sharing selected posts. Data will be stored for the period necessary to achieve the set out purposes. You have the right to access your data and subject to the law: the right to rectify, delete, limit processing, the right to transfer data, the right to object, and the right to withdraw consent at any time. You have the right to lodge a complaint to the supervisory authority responsible for the protection of personal data in the Member State of your normal residence, work, or any alleged violation.
8. Participants provide personal data voluntarily. However, lack of thereof may make it impossible to join the Charity Event.
§ 4. COMPLAINTS
1. Any complaints regarding the Charity Event procedure should be reported to the Organizer at the email address: [email protected].
2. The Organizer shall investigate complaints within 14 business days of the receipt of the complaint.
§ 5. FINAL PROVISIONS
1. The Organizer reserves the right to change the provisions of these Terms at any time. The Organizer shall promptly inform the Participants about each change to these Terms by publishing relevant information on https://displate.com/blog.
2. The information about Charity Event contained in any information and promotional materials, in particular on Organizer’s blog (https://displate.com/blog), has only auxiliary character; the scope of rights and obligations of the Participant and Organizer is set out in these Terms.
3. The Organizer is not liable for cancellation, changes of deadlines, or change of conditions of the Charity Event as a result of unpredictable circumstances or events beyond its control.
4. These Terms and the Charity Event are governed by Polish law.
5. Any disputes that may arise between the Organizer and the Participants connected with the Charity Event shall be resolved as far as possible in good faith by negotiations. In case the agreement is not reached by negotiations, a dispute shall be resolved by a common court competent for the registered office of the Organizer.
6. These Terms enter into force on the date of their publication.
7. These Terms will be available on the Organizer’s blog (https://displate.com/blog).
